If you’re talking compensatory damages = cost of medical treatments, lost wages, and diminished future wages….
If you’re talking punitive damages, depends on negligence and ability to pay, I’ve known many a small business to file bankruptcy over such [punitive] claims, and no one wins!
work related injuries come under the authority of the department of labor and industries…. so, you are dealing with the state, cost of treatment, time loss etc. you have to talk to them about getting those taken care of. Often, they will offer you a settlement once treatment is completed. Now you can hire an attorney and fight for more than what they offer you, but usually in the end, the attorney gets most of the money you may win in a settlement fought out in the courts, and would have done better to just accept what the state offered in the first place, it sucks but that’s the truth. For instance, my friend had bilateral carpal tunnel syndrome from working on a lathe for seven years. After treatment, the state offered him a settlement of 10,000 dollars… he felt he had more coming, so he hired an attorney, the court awarded him 65,000 dollars, but, the attorney’s fees after all was said and done left him with just 8,000 dollars. He’d have done better to take the settlement the state offered instead of making the attorney rich.
